While there is still an off-chance that the US Supreme Court may intervene, it seems increasingly likely that Joe Biden will be in the White House next year.
And if that happens, a massive amount of gun control legislation and executive orders will be on the table.
Gun taxes, a ban on our AR-15’s, a national gun owner registry, mag bans, national ‘Red Flag Gun Seizure’ law — everything will be on the table!
How much can he get passed?
That remains to be seen, as both Georgia Senate races are headed to a January 5th run-off and the results of those races will determine who controls the Senate for the next two years.
Of course, Nancy Pelosi is still the Speaker of the House, but she is running the smallest majority that the House has had in over 100 years!
Bottom line: if gun owners stand together and hold the line, we may be able to defeat Biden’s legislative agenda.
But we can’t count on that. So we need to do everything we can to protect our freedoms here in Wyoming once the legislature gavels back into session in Cheyenne.
And that is why one of our top priorities for the 2021 legislative session will be passage of the Second Amendment Preservation Act (SAPA,) which would nullify all federal gun control laws!
While this legislation is still being finalized, I can tell you that the Second Amendment Preservation Act would nullify federal gun control by requiring that Wyoming peace officers ignore federal gun control laws.
The bill accomplishes this in four primary ways:
>>> First it states that no public officers at the state, county or local level shall have the authority to enforce federal laws of any kind that infringe on our right to keep and bear arms.
In other words, it would be against the law for anti-gun localities like Cheyenne to enforce federal gun control!
>>> Second, it protects the careers of constitutionally-minded peace officers in Wyoming who disregard illegal and unconstitutional federal mandates, by ordering them to only enforce gun laws passed by state lawmakers!
Far different than simply giving cops the option of ignoring federal gun control, this language protects them by ordering them to only enforce Wyoming gun laws.
>>> Third, it allows anyone whose gun rights have been deprived by Wyoming officials who ignore this law and enforce federal gun control law to bring civil charges against those officials.
The problem with the bill that was filed in Cheyenne last year (not a WYGO bill) was that it was totally devoid of teeth, relying on the appointed Attorney General’s office to stand in the gap for gun owner and enforce violations of SAPA law. This bill allows you to bring a suit against government agents on your own.
>>> Finally, recognizing that lawsuit threats hold no water for government officials who ordinarily enjoy total immunity from civil suits, the bill states that official/qualified immunity shall not be allowed as an affirmative defense.
This is a gentle warning to anti-gun local governments who may be tempted to ignore SAPA law, be reminding them that they run the risk of having to personally pay civil fines for their actions.
I’m sure you will agree this is the best SAPA legislation that Wyoming has ever seen.
